Agreement to these Terms

These Terms of Use ("Terms") govern your access to and use of flowcrm.si and related pages (the "Site"), operated by Cyberarcmsp Consulting Services, which develops and maintains FlowCRM. By using the Site you agree to these Terms. If you do not agree, do not use the Site.

Use of the FlowCRM product by a customer is governed by our Customer Terms of Service or a signed agreement, which take priority over these Terms for the product.

Accounts

If you create an account, you must give accurate information, keep your sign-in details confidential and tell us promptly about any unauthorised use. You are responsible for activity under your account.

Access to the Site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Site for your own business or personal purposes. You agree not to:

• copy, modify, sell, rent or exploit the Site or its content except as these Terms allow;
• reverse engineer the Site or access it to build a competing product;
• scrape the Site at a volume or in a way that burdens it, or bypass any measure that limits access (search engines and AI assistants may index public pages, as our robots.txt allows);
• use the Site for anything unlawful, harmful or fraudulent, or submit false information through its forms;
• interfere with the Site's security or operation, or upload malware.

Intellectual property

The Site, its design, text, graphics, product demonstrations and the FlowCRM name and logo belong to Cyberarcmsp Consulting Services or its licensors and are protected by law. Product screens on the Site are fictional demonstrations. If you send us feedback, we may use it without obligation to you.

Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain what we collect and how we use it.

Third-party services

The Site may link to or use third-party services, such as Google and Formspree. We do not control them and are not responsible for their content or practices; your use of them is governed by their own terms.

Pricing information

Prices, plans and features on the Site are offered subject to change. Features marked Soon are not yet available and are not charged until they ship. The price you pay is the one in your signed quote or order.

Indemnification

You agree to indemnify Cyberarcmsp Consulting Services and its personnel against claims and reasonable costs arising out of your misuse of the Site or your breach of these Terms or applicable law.

Disclaimers

To the fullest extent permitted by law, the Site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful code. Information on the Site is general and is not legal, tax or financial advice.

Limitation of liability

To the maximum extent permitted by law, Cyberarcmsp Consulting Services will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of or relating to your use of (or inability to use) the Site. Nothing in these Terms limits liability that cannot be limited by law.

Suspension and termination

We may suspend or end your access to the Site at any time if we reasonably believe you have breached these Terms. The sections on intellectual property, indemnification, disclaimers, limitation of liability and governing law survive termination.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any non-waivable rights you have under the law of the country where you live, the courts at Hyderabad, Telangana, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may update these Terms by posting a new version here with its date; continued use after that means you accept the changes.
